Terms and Conditions
- A Signed Sales Agreement is a binding agreement for payment and adoption of a cat/kitten. The Buyer/Owner of said cat/kitten agrees to purchase the cat/kitten upon the Breeder’s receipt of any Payment towards purchase. Therefore, receipt of payment supersedes a signed Sales Agreement being in the possession of the Breeder and is binding to the purchase of said cat/kitten and will be held in lieu of a Sales Agreement. Buyer/Owner agrees to follow the same policies as that of a Signed Sales Agreement. Sales Agreement should be signed and returned to Breeder at the time of payment in full.
- Any payment made to the Breeder will be considered non-refundable. Full payment is due in CASH, no later than the date the kitten will be available to go home. NO money will be refunded. *The Breeder has the right to refuse ownership to any person at any time if he/she feels the situation is not suitable. If the Breeder chooses this right, under this, and ONLY this situation will the money be refunded. The Breeder will also be the one to choose the time frame and method of payment. The original money paid will be returned to the refused Buyer.
- Cats sold as pets or show alters are not to be bred, and WILL be altered, at Buyer/Owners expense, no later than 7 months of age. By this contract agreement, Breeder must receive a hard copy proof of alter, mailed to us no later than one year from the birth date of the kitten. Emailed copies will NOT be accepted. You must MAIL us Proof of alter. Lyonsgates’ owners have been breeding pedigreed cats since 1989. Due to the recent rise in scammers and fraudulent use of the Lyonsgate Cattery name, NO registration papers are provided for Pet kittens and cats. Show alters ONLY will be sent registration papers after the hard copy proof of alter is received.
- Cats sold as pets will not be shown in competition. No exceptions.
- Cats sold for breeding or show purposes will have registration papers provided at the time of purchase or, if they are not yet available, as soon as possible after purchase.
- Cats sold for breeding purposes are guaranteed fertile unless infertility results from an injury or disease, including Pyometra, occurring after purchase. If a breeder cat is not fertile (as accepted above), the Breeder will replace the cat with one of equal value. No offspring from this direct line shall be sold back to Colorado. Pet or Otherwise.
- Cat/Kitten must be picked up within 2 weeks of being notified that the Kitten/Cat being adopted is ready to go to its new home. Otherwise, all money already paid will be forfeited to the breeder, and the kitten or cat will be available for adoption to another home. In case of inclement weather, preventing safe air transportation, the Breeder agrees to hold the cat/kitten at no charge to the Buyer/Owner until the weather is suitable to safely ship. We only ship to homes that have already seen the kitten in person or who sign a waiver for this option to meet the kitten in person first, accept the health condition of the Kitten to be good, and agree to all requirements and statements in this contract for health guarantee and adoption fee charges.
- If you choose to fly into DIA to meet the kitten and breeder, or if you are picking it up at your home Airport, all dates and flights must be pre-arranged in agreement of dates by the Breeder and Buyer, as the Breeder has a limited schedule for meeting.
- Availability for pick up dates are set by the Breeder. If you cannot pick up at this set date, than the date will automatically go to the Breeders next scheduled available date.
- If last minute cancellation, a new Health Certificate will need to be issued at the Buyer/Owners expense. This new fee will be due immediately to make appropriate changes for the changed ship date. This will be done only two times. If the Buyer/Owner fails to make arrangement for Pick-up by the 3rd scheduled date by the Breeder, the kitten/cat is forfeited, can be sold to another Buyer/Owner, and no money will be refunded.
- A confirmation from the Breeder for shipping will be made approximately 24 hours prior to ship date, however the Breeder will be in contact prior to arrangements for available shipping dates for the expected month of shipping.
- If you pick up at the airport, you will need to pay all flight costs to transport back home with you though.
- Breeder reserves the right to replace said kitten if a kitten is not ready to leave at the standard age due to either developmental delays or health concerns as soon as a suitable replacement becomes available. It may be possible for the original kitten adopted to go home at a later date and time upon Breeder’s and Breeder’s Veterinarian's determination. However, if it is recommended by the Breeder for a replacement cat/kitten, and the Buyer chooses to wait for the original kitten, against the Breeder’s decision, all health guarantees will be null and void, and the Buyer surrenders all rights to a claim for another cat/kitten. Any extra shipping expenses will be the Buyer's responsibility. No money will be refunded.
- HEALTH GUARANTEE: This cat is, to the best of our knowledge, healthy at the time of sale. The vaccination and worming information will be provided in a Health Pet Record envelope at the time of pick up or shipping. These are living animals, it is not uncommon for a kitten to show signs of stress through watery eyes and nose discharge, diarrhea and constipation, within the first week of transfer to a new home. This oftentimes will clear up without any medications once the kitten becomes more comfortable with his new home. Breeder’s Health agreement is exactly as follows.
- The kitten is to be seen by a Certified Veterinarian within seventy-two (72) hours of pick-up from the cattery or upon the time of shipment, at the Buyer/Owner’s expense. (Sunday’s and Holiday’s excluded from this time period). If you have other pets, Breeder requires you place the new arrival in isolation for a minimum of two weeks. Buyer/Owner’s agrees to take overall measures to reduce stress during the integration period, by having patience at this special adjustment time. Kitten is to be given a lot of attention to be able to bond with their new owners. The 72 hour time period begins at the point that the cat/kitten leaves the possession of the Breeder, whether it is at the cattery or at some point of shipping. If shipped, the kitten/cat, comes to you with a veterinarian’s health certificate, and all kittens/cats come with a record of vaccinations and de-worming. Please provide a copy of this to your veterinarian so that follow-up booster vaccinations can be scheduled. If any concern with the kitten/cat is found by the veterinarian within this 72-hour time period, the Breeder must be allowed to speak directly to the Buyer/Owner’s veterinarian within three days for the Breeder’s guarantee to apply. If the concern is of a treatable nature, The Buyer/Owner then has the choice to…
- i. Return the kitten to the breeder, at the Buyer/Owner’s expense, for the Breeder to complete treatment at the Breeder's cost until the kitten is well. Or
- The Buyer/Owner can choose to treat the kitten themselves at their own expense.
- Failure to make this report within this time frame will void this warranty. The Health Guarantee ends after 72 hours, and any care concerns of the kitten are completely the Buyer/Owner’s responsibility after this time period ends.
- If the cat/kitten is found to be in unsound health by a licensed veterinarian within the 72 hours, the cat/kitten MUST be returned to Breeder, and Buyer/Owner may request a replacement with another cat/kitten of equal value. “Unsound health” shall be defined as any condition that is “life threatening” or “incurable “and shall not include curable conditions of infections such as colds, virus, bacterial infections, skin rashes, fungus, or parasites. Said replacement will be made as soon as a suitable replacement becomes available. A medical report signed by the examining licensed veterinarian must be provided to the Breeder prior to a replacement being made. There shall be no replacement unless under the Health Guarantee (with the 72-hour period only except as stated below). The Breeder will not replace any cat or kitten that has not received adequate and appropriate care from its new owner. It is the responsibility of the Buyer/Owner to provide immediate veterinary care (at the Buyer/Owner’s own expense) to any cat/kitten showing signs of illness or distress and failure to do so will render any guarantee null and void. Once a replacement cat/kitten has been offered to the Buyer/Owner, and the Buyer/Owner declines to accept the cat/kitten, or if the Buyer/Owner chooses to select a kitten from another cattery/party, and does not want a replacement kitten from the Breeder, then this contract is considered fulfilled and the Buyer/Owner surrenders all rights to a claim for another cat/kitten. No money will be refunded under any circumstances other than paragraph 2 page 2. There are no further Guarantees.
- The Breeder does not guarantee against allergies associated with this cat/kitten. Please be sure you are not allergic to the cat/kitten prior to signing this contract. The Breeder reserves first right of refusal for any kitten leaving Buyer/Owners ownership before going to another owner. Therefore, you must contact the Breeder before you relinquish right of ownership to any other party. There are NO refunds if the Breeder chooses to take back ownership of this cat or kitten upon Buyer/Owners surrendering of ownership.
- Food and Vitamins - Buyer/Owner agrees to feed according to Lyonsgate's provided feeding instructions and will not alter food unless required by a certified Veterinarian. Buyer/Owner also agrees to provide NuVet Plus Feline Powder vitamins to the kitten for 24 months minimum. The phone number to NuVet is 1-800-474-7044. Use the order code 31540 . NuVet will notify us once you have ordered your vitamins. If vitamins are not ordered before 15 days of pickup of the kitten/cat, the health agreement is null and void.
REFUNDS AND REPLACEMENTS AND EXPENSES: There shall be no refund of purchase price, shipping charges or other costs. There shall be replacement of the cat/kitten only under the circumstances provided in the health guarantee. All shipping expenses in conjunction with a replacement kitten are the full responsibility of the Buyer/Owner.
- Under no circumstance is a cat or kitten to be destroyed prior to notification by the Buyer/Owner to the Breeder. Any cat/kitten for which the Buyer/Owner expects replacement must be returned to the Breeder (at the Buyer/Owner’s expense) so that identity of the cat/kitten can be verified.
- Should the cat/kitten die within this 72 hour time period, as a direct result of an unknown (at the time of sale) congenital birth defect, Buyer agrees to have a necropsy done by a feline pathologist specialist. So long as the Breeder is still breeding Maine Coons, and is not retired, Breeder will replace any kitten or cat if it dies suddenly within one year after purchase from a documented genetic cause of death. Trauma, abuse or neglect will void the guarantee.
- The Breeder is not responsible for kittens/cats lost, stolen, or resulting in mortality or sickness during shipping, after acceptance by the airline carrier. It is the responsibility of the Buyer/Owner to file a claim with the airline carrier if the cat/kitten is lost, damaged, stolen, delayed resulting in mortality or sickness of cat/kitten.
- The Breeder guarantees to maintain the cattery as Felv/FIV negative
- The Buyer/Owner has the option to have the kitten tested for Felv/FIV within the 72 hours of leaving the cattery. The Breeder will replace any kitten that test positive for Felv/FIV. A positive test must include a written test result from a certified laboratory. If the Buyer/Owner has other cats in the household, they must also be tested negative for Felv/FIV by a licensedveterinarian prior to the new cat/kitten entering the household and again be tested negative at the time of the positive result before any replacement kitten will be considered. This warranty is voided if the Buyer/Owner has cats that are allowed outdoors.
- If the Buyer/Owner has other cats in the household, these cats must be up to date and current on their annual vaccinations, including rabies, and have a negative fecal prior to the arrival of the new cat/kitten, or warranty is void.
- If the Buyer/Owner declines the offer of the replacement kitten/cat, then this contract is considered fulfilled and the Buyer/Owner surrenders all rights to request another cat.
Medical Expenses – Buyer/Owner agrees that Breeder assumes no responsibility for any future veterinary or other medical costs including but not limited to:
i) the cost of the mandatory spay or neuter once the kitten reaches the proper age.
ii) all veterinarian recommended vaccinations
iii) heartworm testing and the preventative
iiii) all other proper veterinarian attention
18. THE BUYER/OWNER assumes responsibility of all expenses incurred in relation to the
cat/kitten after said cat/kitten leaves the possession of the Breeder, as well as any expenses
incurred at the request of the Buyer/Owner before the cat/kitten leaves possession of the
Breeder. If for any reason the cat/kitten is returned to the Breeder, the Buyer/Owner agrees to
pay all expenses, included in the return of said cat/kitten, as well as all costs associated with
the new shipment of a replacement kitten.
The FIP and FeLV vaccinations are not given by the Breeder so that the Buyer/Owner can properly test for such viruses upon time of possession. These vaccines are not recommended by the Breeder because of the risks of side effects. However if you choose to give said vaccines due to special circumstances, there is no Warranty from the Breeder for any affects this vaccine may have on the cat/kitten.
The Buyer/Owner agrees to the following:
b. The cat will receive its booster shots as recommended by a licensed Veterinarian, and yearly veterinary examinations.
c. The cat will not be denied needed veterinary attention. If the Buyer/Owner is unsure whether or not the animal is in need of medical services, a vet will be contacted, the situation will be explained, and the vet's advice will be acted upon.
d. The cat will not be allowed outside except on a leash (under close supervision), or in a completely enclosed run.
e. The cat will be given the proper diet and will have fresh water available at all times.
f. The cat will receive frequent and kind human attention.
g. If for reasons other than the animal's health the Buyer/Owner cannot retain ownership of the Pet cat/kitten or Show Neuter Cat/kitten, and the cat cannot go to an immediate family member, who is in full agreement to follow this contract, the Breeder will be given the first right of refusal. Pet cat/kittens, and Show alters – for no more than shipping expenses, chosen by the Breeder, This will include carrier, airfare, and vet Health Certificate only. (Bedding, food and toys are of the shipper’s responsibility). If the cat or kitten was sold for breeding purposes, the Breeder gets first right of refusal, with the cat remaining unaltered at the time of relinquishment of ownership by the Buyer/Owner before being offered to a family member, or any other breeder. Additionally, the Buyer/Owner agrees to obtain the Breeder's permission before selling or leasing an unaltered cat from this cattery to any other party for breeding purposes.
h. No cat/kitten from this cattery may be sold or given to an animal shelter, sold or given to a pet store, abandoned, sold or given to a laboratory.
19. Buyer/Owner agrees to resolve any concerns through this contract agreement and refrain
from disparaging in any manner related to Lyonsgate and its owners, in any format, verbal,
written or digital, nor otherwise take any action which could reasonably be expected to
adversely affect Lyonsgate, or party’s personal or professional reputation in any manner.
Legal disputes over this contract will be brought in a court chosen by the breeder, within the
State the Breeder lives. All court costs and related charges, including attorney’s fees that are
associated with the Breeder enforcing the terms of this contract will be the full responsibility
of the Buyer/Owner. Deletions or additions to the sales agreement made by anyone other
than the Breeder are subject to legal action.
